Terms of Service

Welcome to Aprivo. These Terms of Service (“Terms”) govern your use of the Aprivo website at aprivo.ai and the Aprivo application (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Service Description

Aprivo is an AI-powered software-as-a-service (SaaS) platform that helps users remediate accessibility issues in Microsoft PowerPoint files. The Service scans uploaded presentations for WCAG compliance issues — including missing alt text, reading order problems, contrast issues, slide titles, and language tags — and uses artificial intelligence to suggest fixes.

2. Account Terms

• You must be at least 18 years old to create an account and use the Service.
• You are responsible for maintaining the security of your account credentials. Do not share your password with anyone.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account and keep it up to date.
• Aprivo reserves the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use the Service only for its intended purpose. You may not:

• Upload files that contain malware, viruses, or other malicious code.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use the Service to process files that contain illegal content.
• Abuse, overload, or interfere with the Service or its infrastructure.
• Resell or redistribute the Service without written permission from Aprivo.
• Use automated tools to scrape, crawl, or extract data from the Service.

Prohibited Content

You may not upload files containing pornographic, sexually explicit, or obscene material of any kind. Aprivo monitors uploads for policy violations. If pornographic or sexually explicit content is detected in any upload, your account will be terminated immediately and permanently, with no refund of any kind. This policy is strictly enforced without exception.

Image and Content Ownership

You represent and warrant that you own or have the necessary rights, licenses, and permissions for all content — including images, text, and media — contained in the files you upload to the Service. You are solely responsible for ensuring that your uploaded content does not infringe on the intellectual property rights, copyrights, trademarks, or other legal rights of any third party. Aprivo assumes no responsibility for verifying the ownership or legal status of content within your files.

4. Intellectual Property

Your files. You retain full ownership of all PowerPoint files and content you upload to the Service. Aprivo does not claim any ownership rights over your files or the remediated output.

Our service. Aprivo and its licensors retain all rights, title, and interest in the Service, including the website, application, AI models, algorithms, design, and documentation. Nothing in these Terms grants you any right to use Aprivo’s trademarks, logos, or branding without prior written consent.

5. Payment Terms

• Paid plans are billed monthly. Your subscription renews automatically at the end of each billing cycle unless you cancel.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then.
• Payments are processed securely through Stripe.
• Aprivo reserves the right to change pricing with 30 days’ notice. Price changes will take effect at the start of your next billing cycle.
• If payment fails, we may suspend access to paid features until the balance is resolved.

Refund Policy

All subscription payments are non-refundable. Because Aprivo offers a free tier that allows you to evaluate the Service before purchasing, we do not issue refunds for paid subscriptions. When you cancel, you retain access to paid features through the end of your current billing period, but no partial or prorated refund will be issued for the remaining time.

If Aprivo terminates your account for reasons other than a policy violation, we will issue a prorated credit for any unused portion of your current billing period.

Accounts terminated for policy violations — including but not limited to uploading prohibited content — are not eligible for any refund, credit, or compensation of any kind.

6. Data Handling

• Files you upload are processed solely for the purpose of providing accessibility remediation.
• All uploaded files are stored using encryption at rest and in transit.
• Files are automatically deleted from our systems 90 days after upload.
• We do not sell your data or use your uploaded content to train AI models.

7. AI-Generated Content

Aprivo uses artificial intelligence to generate alt text suggestions and accessibility fixes. AI can and does make mistakes. By using the Service, you acknowledge and agree to the following:

• AI-generated suggestions are provided as recommendations only — they are not guaranteed to be accurate, complete, or appropriate for your specific content or context.
• AI output may contain errors, inaccuracies, omissions, or contextually inappropriate descriptions. It is your responsibility to review, verify, and approve all AI-generated content before accepting it.
• Aprivo does not guarantee that AI-assisted remediation will satisfy any specific accessibility standard, regulatory requirement, or legal obligation, including but not limited to WCAG, Section 508, or ADA requirements.
• You are solely and entirely responsible for the accuracy, appropriateness, and legal compliance of the content in your final documents, whether or not that content was generated or modified by Aprivo’s AI.
• Aprivo shall not be held liable for any damages, penalties, legal actions, or other consequences arising from inaccurate, incomplete, or inappropriate AI-generated content that you chose to accept and include in your documents.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Aprivo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Aprivo’s total liability for any claim related to the Service shall not exceed the amount you paid to Aprivo in the 12 months preceding the claim.
• Aprivo does not warrant that the Service will be uninterrupted, error-free, or completely secure.

File Handling Disclaimer

Aprivo is not liable for any damage, corruption, loss, or alteration of files that occurs during upload, processing, remediation, or download. While we take reasonable care to preserve the integrity of your files, the Service modifies PowerPoint files as part of its core function, and unintended changes may occur. You are solely responsible for maintaining backup copies of all files before uploading them to the Service. Aprivo strongly recommends that you always keep a copy of your original, unmodified file. By uploading a file, you acknowledge that the Service will modify it and that Aprivo bears no responsibility for the resulting output.

9. Termination

You may close your account at any time by contacting us at support@aprivo.ai or through your account settings.

Aprivo may suspend or terminate your account if you violate these Terms or if we reasonably believe your use of the Service poses a risk to Aprivo, other users, or third parties. We will make reasonable efforts to notify you before or promptly after any termination, unless doing so would be impractical or pose a security risk.

Upon termination, your right to access the Service ends immediately. Any data associated with your account will be deleted in accordance with our data retention practices.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Kentucky.
